Declare null and Void process of selecting AGF —applicant urges NICN

The National Industrial Court of Nigeria (NICN) has been urged to declare the process of selection of the Account General of the Federation begun by the office of the Head of service of the Federation null and void.

Mr. Joshua Kadmi Luka, who is seeking nullification of the process in a writ of summons endorsed by Ibrahim Angula, SAN, is also praying the court to allow him participate in the process of selection of Accountant General of the Federation.

Co-joined in the Suit as respondents are Prince Lateef Olasumkanmi Fagbemi (Attorney General of the Federation), Miss Didi Esther Walson Jackson (Head of Service of the Federation).

According to the writ of summons made available to journalists, the exclusion of Mr. Joshua from participating in the selection process for Accountant General of the Federation on an allegation without hearing was an infringement of his rights to fair hearing and therefore, null and void.

Mr. Joshua has posed six questions for determination in the course of trial, with the law requiring the respondents to attend the court within 14 days.

Among other questions by Mr. Joshua are whether or not it is the duty of the Federal Civil Sevicw Commission to appoint the AG of the Federation, whether or not she is empowered by law to supervise, order and/or commence the process for the section of Permanent Secretaries/Account General of the Federation, in clear violation of the Constitution of Nigeria.
